Terms of Service

These terms govern your use of Enduring Voices (enduringvoices.com), operated by SaaS CRO LLC dba Enduring Voices. You accept them when you purchase a gift and again when you claim one. Please read them — they are written to be understood.

1. Eligibility

You must be at least 18 years old to purchase, claim, or record on Enduring Voices. By purchasing or claiming a gift, you confirm that you are 18 years of age or older. Enduring Voices records a person's answers to a small set of questions and produces one finished audio episode from them.

2. The gift, and how the three parties fit together

Every Enduring Voices gift involves three roles:

  • The gifter purchases the gift and authors up to 5 questions.
  • The recipient claims the gift, records the answers, and is the owner of the resulting recordings and episode.
  • Enduring Voices produces, hosts, and delivers the episode.

These Terms are accepted twice: by the gifter at checkout, and by the recipient at claim. A recipient who does not accept them does not have to record, and the gifter may request a refund under the Refund Policy.

The gifter represents that they have a genuine personal or professional relationship with the recipient, and warrants that every question they author complies with the content rules in §5. Enduring Voices is not a means to contact strangers.

3. What you get

The Enduring Voices Gift — $149, one time.

  • One produced audio episode in the recipient's own voice
  • Up to 10 questions in total, of which up to 5 may be written by the gifter; the rest are drawn from the chosen theme
  • A 20-minute total answer cap across the episode, enforced by the service
  • A full transcript and a keepsake PDF
  • Downloadable audio, transcript, and PDF — free, with no account or subscription required to keep and use what you have downloaded
  • Hosting included for the life of the service, guaranteed for a minimum of four years (4 years) from episode delivery — no renewals, no hosting fees, nothing more to pay

Additional Episode — $49, one time.

A future purchase option that adds one further episode for the same recipient on the same terms. It is named here so pricing is disclosed in advance; it is not yet offered for sale.

Forever Archive — a future option.

A future one-time purchase that extends guaranteed hosting beyond the included minimum term. It is named here so it is disclosed in advance; no price is set and it is not yet offered for sale.

There are no recurring fees of any kind in the current product: no subscriptions, no plans, no monthly limits, no credits, and no hosting fees. Prices are in US dollars and exclude local taxes. We may change prices for future purchases; a purchase already made is never repriced.

4. Ownership, downloads, and our hosting commitment

Nothing on Enduring Voices expires. Claim links, episodes, share links, downloads, and the archive have no time limit. There is no window in which a recipient must record, and no window in which an episode must be listened to.

Ownership. The recordings and the episode belong to the recipient and their family. Copies they download — audio, transcripts, and the keepsake PDF — are theirs unconditionally and perpetually, on their own devices, with no account, subscription, or payment ever required to keep or use them. Nothing we do or stop doing can take a downloaded copy away.

Hosting commitment. The one-time purchase price includes hosting for the life of the service, guaranteed for a minimum of four years (4 years) from episode delivery, with no renewals and no hosting fees. That term is a floor, not a countdown, and it is not an expiry date: after it, hosting simply continues at the discretion of SaaS CRO LLC dba Enduring Voices for as long as the service operates. Our hosting is a convenience layered on top of ownership, not a condition of access.

No perpetual-availability promise. Hosting beyond the guaranteed minimum term, while fully intended, is not a contractual promise of perpetual availability. This is precisely why every episode is downloadable from day one.

The recipient grants SaaS CRO LLC dba Enduring Voices a non-exclusive, royalty-free license to host, store, process, transcribe, and deliver their content solely to operate the service and to share it with the people they choose. We do not use it for marketing without separate written permission. The license ends when the content is deleted, except for residual copies in routine backups, which are purged on backup rotation.

See §12 for the wind-down covenant that applies if the service is ever discontinued.

5. Prohibited use — impersonation, misrepresentation, and consent

You may not use Enduring Voices to impersonate, defame, or misrepresent any real individual, living or deceased, or to produce audio or written material falsely attributed to a named person. You may not submit content that could constitute defamation, libel, false light, or impersonation under applicable law.

You represent and warrant that you are the person whose experience is being recorded, or that you have explicit authorization from that person.

Recordings of other people

Your recording must contain only your own voice unless every other person captured in it has given you permission to record and publish them. California and many other jurisdictions require the consent of ALL parties to record a conversation. By submitting a recording you represent and warrant that you have obtained every consent required by applicable law — including all-party-consent recording laws (such as California Penal Code §632) and biometric-information laws — from every identifiable person in it.

Prohibited content additionally includes content that is unlawful, harassing, hateful, sexually explicit, or that discloses another person's private information without consent. We may remove content and terminate accounts that violate this section. Repeat violations result in permanent termination.

6. Moderation and human review

Transcripts are screened after transcription. When something is flagged, the episode is held for human review before delivery — it is never auto-deleted and never published while held. We aim to review holds within 72 hours and will tell the recipient the outcome.

7. AI processing

Enduring Voices uses AI to transcribe audio and to help generate questions and production text. By using the service you consent to this processing. Our processors are:

  • Deepgram (deepgram.com) — speech-to-text transcription and voice narration
  • Anthropic (anthropic.com) — question generation and production text such as titles and summaries

Both processors are United States-based.

Content is processed solely to deliver the service. Neither we nor our providers use your content to train AI models.

AI-generated outputs — transcripts, questions, summaries — are produced by automated systems, may contain errors, and are provided for informational purposes only. Review them before relying on them.

8. Our no-cloning covenant

We will never synthesize, clone, or recreate any person's voice, and we will never use anyone's recordings, transcripts, or episodes to train AI models. The voice on an Enduring Voices episode is always the real person who spoke it. This is a commitment we make to you, not a preference we may quietly change.

9. What we do not do

  • We do not sell your personal data
  • We do not train AI models on your voice, transcripts, or episodes
  • We do not clone or synthesize anyone's voice
  • We do not share episodes with anyone the owner has not chosen
  • We do not require a subscription to keep or download what you own

10. Payments and refunds

Payments are one-time purchases processed by Paddle (paddle.com), acting as Merchant of Record for all transactions; Paddle handles billing disputes, tax, and refund processing. Payments are not yet enabled on this service.

Refunds are governed by our Refund Policy: a full refund within 14 days of purchase while the gift is unclaimed and unrecorded.

11. Liability

The service is provided as-is without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of it.

Our total liability to you for any claim is limited to the amount you paid us in the 12 months preceding the claim.

Data loss. While we take commercially reasonable measures to safeguard and back up content, we do not guarantee that content will never be lost, corrupted, or become unavailable, whether through technical failure, third-party provider failure, security incident, or otherwise. To the fullest extent permitted by law, we are not liable for loss of, damage to, or inability to access your content. Download and keep your own copies — the service gives you the audio, the transcript, and the PDF for exactly this reason.

Hosting obligations. Our hosting obligations under §4, including the guaranteed minimum term, are fully discharged where export and download of the audio, transcript, and keepsake PDF were made available to you as described in §12. Our aggregate liability relating to hosting or availability never exceeds the one-time price you paid.

12. Service changes, discontinuation, and wind-down

We may modify, suspend, or discontinue any feature, or the service as a whole.

Wind-down covenant. If we discontinue the service entirely, we will give at least 30 days' advance notice to the email on your account and keep full export and download of your audio, transcripts, and keepsake PDFs available throughout that entire notice period, at no charge, so you can take everything with you. This export obligation expressly survives within the guaranteed hosting term described in §4 and survives any termination of these terms during it.

Hosting after the guaranteed minimum term continues at our discretion for as long as the service operates; it is not a guarantee of perpetual availability, which is precisely why everything is downloadable from day one and why a downloaded copy is yours forever.

13. Deletion and termination

You may delete your account at any time. When you do, your data is permanently hard-deleted within 30 days.

We may suspend or terminate accounts that violate these terms, with or without notice depending on severity. On termination your right to use the service ends immediately.

14. Changes to these terms

We may update these terms. We will notify registered users by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in San Diego County, California, and both parties consent to that jurisdiction and venue.

To the fullest extent permitted by law, both parties waive the right to a jury trial and agree that any claim may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Nothing here limits either party's right to seek relief in small-claims court, or waives rights that cannot be waived under California law, including rights under California Civil Code §1542 where applicable.

16. DMCA agent / copyright takedowns

We respect intellectual property rights. If you believe content on Enduring Voices infringes your copyright, send a written notice to our designated DMCA agent.

17. Indemnification

You agree to defend, indemnify, and hold harmless SaaS CRO LLC dba Enduring Voices, its officers, and agents from any claims, damages, liabilities, and reasonable attorneys' fees arising from (a) content you submit, record, or publish, (b) questions you author as a gifter, (c) your violation of these Terms, or (d) your violation of any third party's rights, including intellectual-property, privacy, publicity, or recording-consent rights.
